Case Markup 

The Editors carry out the following tasks when marking up a case on JustCite:

  • Checking for lower hearings of the same case and, where relevant, for other reports of the case.
  • This helps to avoid data duplication, and ensures that a case’s appellate history is contained within a single record.

  • Setting the subject terms.
  • Subject terms are taken from the catchwords in the headnote of the case report. If none are provided, the team will add them.

  • Setting the jurisdiction.
  • JustCite uses its own taxonomy of supranational groupings, nations and sub-national component jurisdictions.

  • Adding appellate status where relevant.
  • Standardising the case name according to our Case Naming Conventions
  • Adding crosslinks to legislative provisions, other cases and journal articles, and determining the nature of the link relationship according to our Case Relationship Definitions and other markup policies.

Markup Policies

There are three types of case on JustCite: reported, unreported and recognised. The markup policy is different for each.

Reported cases within our indexed series list

  • Keywords Policy: Keywords provided by the publisher of the report will be added.
  • Cited Cases Policy: The editor will add any cases cited within the Judgment but not any cases listed as cited within argument.
  • Legislation Policy: The editor will add any sections of legislation referred to within the catchwords or the ‘Legislation Referred to’ section of the headnote.

Unreported Cases (EW)

  • Keywords Policy: An extract from the judgment will be added to assist searching. Subject terms will be added for Supreme Court cases.
  • Cited Cases Policy: Appellate status will be added only, apart from Supreme Court cases which will list any cases cited.
  • Legislation Policy: Legislation cited will be added for Supreme Court cases only.

Unreported Cases (Ire)

  • Keywords Policy: Keywords provided by the publisher of the report will be added.
  • Cited Cases Policy: The editor will add any cases cited within the Judgment but not any cases listed as cited within argument.
  • Legislation Policy: The editor will add any sections of legislation considered by the editor to be significant.

If keywords are not provided for a marked up case, our editorial team will add keywords. However, the size of the JustCite index limits the amount of keywords that can be written per case.

Recognised Titles

  • These cases have not yet been read by the editorial team, but have been listed as a case cited by a marked up case, or have been supplied by our external partners. All that the team can provide is the name, reference, country of origin and court.
  • If the case is subsequently marked up, then more information will be provided.
